Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the HabitRival mobile application or website (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use HabitRival. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized account access
• Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, bully, or harm other users
• Post offensive, discriminatory, or inappropriate content
• Impersonate any person or entity
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools to scrape, crawl, or extract data
• Transmit malware, viruses, or other harmful code
• Cheat or misrepresent your habit check-ins
• Spam or send unsolicited messages to other users

5. User Content

You retain ownership of content you submit to the Service (e.g., challenge descriptions, profile information). By posting content, you grant HabitRival a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for operating and improving the Service.

You are solely responsible for your content and represent that you have all rights necessary to grant this license.

6. Intellectual Property

The HabitRival app, website, logo, design, and all proprietary content are owned by HabitRival and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written permission.

7. In-App Purchases and Subscriptions

HabitRival may offer premium features through in-app purchases or subscriptions processed via Apple's App Store. All purchases are subject to Apple's payment terms. We do not directly handle payment information. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date in your Apple ID settings.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

HabitRival is a habit-tracking tool and is not a substitute for professional health, medical, or wellness advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITRIVAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless HabitRival and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by deleting it from the app settings.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in Delaware.
